South Carolina Department of Transportation

In South Carolina, the South Carolina Department of Transportation (“SCDOT”) is the state agency that promotes safe and efficient transportation.  The SCDOT is established pursuant to S.C. Code Ann. § 57-1-20.  SCDOT has been established as an administrative agency of state government which is comprised of:

  • Division of Mass Transit;
  • Division of Construction Engineering and Planning; and
  • Division of Finance and Administration.

 

SCDOT established the SCDOT Commission (“Commission”) whereby, the Commission may establish other divisions, or ancillary or service divisions as may be necessary for the efficient and economic operation of the division and to carry out the functions and purposes of the division.

The main objective of  the SCDOT is to provide adequate, safe, and efficient transportation services for the movement of people and goods.  The following are the functions and purposes of SCDOT:

  • SCDOT has as its functions and purposes the systematic planning, construction, maintenance, and operation of the state highway system and the development of a statewide mass transit system that is consistent with the needs and desires of the public;
  • SCDOT coordinates all state and federal programs relating to highways among all departments, agencies, and other bodies politic and legally constituted agencies of this State and the performance of such other duties and matters as may be delegated to it pursuant to law.

 

It is unlawful for a member of the commission or an engineer, agent, or other employee, acting for or on behalf of SCDOT, to accept or agree to accept, receive or agree to receive, any[i]:

  • money;
  • contract, promise, undertaking, obligation, gratuity, or security for the payment of money or for the delivery or conveyance of anything of value;
  • political appointment or influence, present, or reward;
  • employment; or
  • other thing of value.

 

Pursuant to S.C. Code Ann. § 57-1-40, any person violating the provisions of the SCDOT is deemed to be guilty of a felony and, upon conviction, and may be imprisoned not more than five years and is also disqualified forever from holding any office of trust or profit under the Constitution or laws of this State.

The SCDOT authorizes deputy directors to[ii]:

  • carry out financial planning and management;
  • carry out accounting systems necessary to comply with all federal or state laws or regulations as well as all policies established by the Comptroller General; and
  • carry out administrative functions, including recording proceedings of the commission and developing policy and procedures to ensure compliance with these policies and procedures;
  • develop a statewide mass transit system; and
  • coordinate the preservation and revitalization of existing rail corridors.
