New Hampshire Department of Transportation

In New Hampshire, the New Hampshire Department of Transportation (“Department”) is a state agency that provides transportation excellence enhancing the quality of life in New Hampshire.  It is administered under the executive direction of a Commissioner of Transportation (“Commissioner”). The Commissioner of the department is appointed by the governor, with the consent of the council, and serves a term of 4 years.  The Commissioner should be qualified to hold that position by reason of education and experience.

The Department, through its officials, is responsible for the following general functions:

  • Planning, developing, and maintaining a state transportation network which will provide for safe and convenient movement of people and goods throughout the state by means of a system of highways, railroads, air service, mass transit, and other practicable modes of transportation, in order to support state growth and economic development and promote the general welfare of the citizens of the state;
  • Performing any regulation of transportation activities required by law which is not within the jurisdiction of another state agency.

 

The Department is authorized to cooperate with the department of administrative services in long range capital planning to meet the needs of the state, as may be requested by the governor and council and subject to their approval.  In addition, the Department is further authorized to:

  • Assist any using agency or institution of the state in the acquisition of lands for a public use, when requested;
  • Employ such technical consultants and other assistants as may be necessary, wherever required in the best interests of the state;

 

The following are some of the functions of the Commissioner:

  • Represent the public interest in the administration of the functions of the department and be responsible to the governor, the general court, and the public for such administration;
  • Consult regularly with regional planning commissions established with regard to department planning activities;
  • Provide for a support unit within Commissioner’s office which includes the function of monitoring projects and conducting audits of Department activities to insure compliance with state and federal contracts, laws, and program objectives;
  • Require the director of the division of finance, in consultation with the Commissioner of administrative services and the state treasurer, to provide for a system of accounts and reports which will insure the integrity and lawful use of all revenues collected by the Department, the use of which is restricted by state or federal law;
  • Approve rates for and regulate every corporation, company, association, joint stock association, partnership and person, their lessees, trustees or receivers appointed by any court, except municipal corporations operating within their corporate limits, owning or operating any toll bridge or toll road.

 

The Department is not deemed to have any duty of care whatsoever with respect to the construction, maintenance or repair of highways or highway bridges thereon.  Upon any highway or other way with respect to which the Department is found to have a duty of care of any kind, its liability will be limited.

There is established within the Department, a position of an unclassified Director of Policy and Administration (“director”). The Commissioner nominates a director of policy and administration for appointment by the governor, with consent of the council.  The director serves a term of four years. The director should be qualified to hold that position by reason of education and experience.  The director also performs such duties as are assigned by the commissioner or deputy commissioner and, in accordance with applicable laws that administer the following:

  • Bureau of human resources;
  • Office of stewardship and compliance;
  • Office of federal compliance;
  • Office of hearings and legislation;
  • Office of public information;
  • Executive office administrative support.
